How do you define mental order?
It’s an abnormal state of mind.
What is a restricted patient?
Patients who are subject to a compulsory treatment order but are considered to present a danger to public.
What is a special patient?
Patients who are detained by way of court order if they are found to be criminally insane or unfit to plead.
What is a Duly Authorized Officers? (DAO)
A qualified nurse who has specialized in the area of mental health and received further training.
How should an officer refer to a 1M in public?
As mentally ill. Not a mental disorder.
How will police become involved in a 1M?
- They are found in a public place.
- A person commits an offense and is apprehended.
- You are called on to assist a DAO or medical practitioner.
Who should make an application for compulsory assessment?
A police offers shouldn’t, it should be a relative over 18 year olds or a doctor.
When can you return a restricted or special patient that is absent without leave or absconded?
You can return to hospital at any time.
When can you return a compulsory treatment patient that is absent without leave or absconded?
You can return/take to hospital if apprehended within 3 months of going missing.
What are the police powers in public place? S.109 MHA92
- Police may apprehend
- Any person wandering at large in a public place
- Behaving in a manner that gives rise to reasonable belief that they may be mentally disordered
- Believe it is in the interest of the person or public to do so.
What are the police powers to assist? S.41 and 110B MHA92
- Police called upon by DAO or Medical practitioner may
- Enter the premises by force if necessary
- Detain the person to be assess OR transport the person to a place nominated by the DAO or Medical practitioner.
How long can you detain a person for the purpose of a medical exam by a DAO or Medical practitioner?
Six hours.
