You work as a therapist at an adult assisted living facility. While you are entering the facility you notice two residents arguing heatedly. It quickly escalates to physical aggression and one of the residents is pushed to the ground. He clearly will have bruises and is very upset and wants you to do something about the other man. Is this a mandated report? What are the resident’s options according to state law?

A

According to MN law, this is not a mandated report. Aggression between residents/patients/clients is not considered physical abuse. As long as the incident did not occur as a result of neglect by the facility, it is not reportable. The resident should make his own decision about whether or not he wants to call the police (on his own) and file a criminal complaint.
