Mental Disorder Defined:

Abnormal state of mind.

Restricted Patient

A

Patients who are SUBJECT to COMPULSORY TREATMENT ORDER and considered a DANGER to PUBLIC

CAN BE DETAINED for return to hospital at ANY TIME

Special Patient

A

Patients who are DETAINED by COURT ORDER who are CRIMINALLY INSANE, or UNFIT TO PLEAD.

CAN BE DETAINED for return to hospital at ANY TIME

DAO

A

Duly Authorised Officer

A qualified Nurse that has specialised in Mental Health and received further specific training.

Application for Compulsory Assesment

A

Anyone over the age of 18yrs.

Can apply

For ANYONE to undergo compulsory assessment for mental disorder.

Usually this is made by a relative, or doctor that carries out the initial examination, but anyone who has witnessed and spent time with someone can apply for this.

STAYS in PSYCHIATRIC UNIT for TREATMENT

A

Lives at HOME and ATTENDS psychiatric unit for TREATMENT

Compulsory Treatment Order Patient

A

Either an

IN-PATIENT,

OR,

OUT-PATIENT

Patient Absent without Leave

A

3 Types:

SPECIAL
And,
RESTRICTED
=
RETURN to HOSPITAL at ANY TIME

Compulsory Treatment,
[If DETAINED within 3 MONTHS of going MISSING]
If not found,
WITHIN 3 MONTHS, reapplication for assessment must occur, if appropriate and necessary.

Section 109 Mental Health Act

A

Police may APPREHEND,

ANY PERSON, at large, in PUBLIC PLACE

AND,

PERSON, BEHAVING, in manner that gives REASONABLE BELIEF, that they may be MENTALLY DISORDERED

AND,

BELIEVE it is in BEST INTERESTS of person, public, or both to do so.

A person Apprehended through this Section, has all the same rights as an arrested person.

You must get them assessed within 6hours, or release them.

Intoxication and Assesement

A

Intoxication is not a reason to prevent assessment.

A person mentally disordered should be provided with assessment within a reasonable time frame, to a MAXIMUM of 6HRS

Detain for sobering (12hrs), is not acceptable for someone suspected of mental disorder/illness.

Section 41 Mental Health Act

A

IF

CALLED Upon for ASSISTANCE by DAO,

POLICE can ENTER, DETAIN, HOLD at LOCATION,
OR,
TRANSPORT AT REQUEST of DAO,

Then BOTH SITUATIONS,

HOLD person UNTIL EXAMINATION and ASSESSMENT can be COMPLETED

Section 110

A

Assisting a MEDICAL PRACTITIONER for URGENT EXAMINATION,

A DOCTOR may ADMINISTER an URGENT SEDATIVE through 110A if NECESSARY

POLICE can ENTER, DETAIN, HOLD at LOCATION,
OR,
TRANSPORT AT REQUEST of DOCTOR, then HOLD
BOTH situations,
UNTIL EXAMINATION and ASSESSMENT can be COMPLETED

POLICE may also ASSIST DOCTOR for administration of URGENT SEDATIVE - 110A(5)

41 - at REQUEST of DAO,
may ENTER any PLACE,
and then,
HOLD, or TRANSPORT,
UNTIL,
DAO ASSESSMENT and EXAMINATION COMPLETE

110 - Assist DOCTOR. Same ability as assisting DAO,
ENTER, DETAIN, HOLD, or TRANSPORT, for purpose of ASSESSMENT and EXAMINATION

Use of Force

A

FORCE may ONLY be USED if ASSISTING DOCTOR, who is acting under PROVISIONS of EMERGENCY s110,

Force should be avoided, but can occasionally be necessary for safety, if patient is DANGER to THEMSELVES,, PUBLIC, or SERIOUS PROPERTY DAMAGE

Positional Asphyxia

A

A Person place in a position that disrupts their ability to breath, while in a state of Excited Delirium, or Hyper agitation, can die from lack of Oxygenation
