What are the requirements for formal visual identification?

A

(MORPAIN)
M * Montague - pictorial record of procedure
O * Others - min of 7 to compare with suspect (so 7+1=8)
R * Record - written record of procedure
P * Procedure - Complies with relevant regulations
A * ASAP - after the offence is recorded
I * Inclusion - witness told suspect may/may not be included
N * No indication - as to the identification of the suspect

When can formal visual identification not be followed?

A

R.S.A.C.S.I

  • R - Suspect refuses to take part in formal parade
  • S - Singular appearance of suspect
  • A - Appearance changed after offence reported
  • C - Chance meeting soon after offence
  • S - Identification made soon after a chance of meeting
  • I - Could not anticipate identification would be an issue
