A

There must be at least two people fighting each other and each must be willingly fighting with the other. You do not have to charge both people with the offence.The definition of public place begins with the words “at any material time”. This informs you that when attempting to class a particular place as a public place, you must take into account the time in question.

A

Not all incidents of people exchanging blows are fights. An innocent man may merely be defending himself from assault. It is up to the attending police officer to, through correct investigative procedures (VAWSEIPO), to find out what actually happened.
